TERMS AND CONDITIONS  

Sweetheart Challenge – Touch Footy Comp 

The Sweetheart Challenge – Touch Footy Comp is a fundraising event for North Shore Heart Research Foundation, ABN 62 002 839 072 CFN 12857 ; 2/82-86 Pacific Highway, St Leonards NSW 2065 (the Foundation), to be held at Gore Hill Park, St Leonards NSW on Sunday 4 March 2012.

Registration & Insurances

• The person who registers a team (the registrant) is deemed by the Foundation to be authorised to do so on behalf of their team.
• The registrant accepts these Terms and Conditions on behalf of themself and the members of their team.
• The registrant shall ensure that the Public Liability and Personal Injury Cover Form is completed with the required information about all players and is supplied to the Foundation no later than 7 days prior to the event. 
• The registrant shall inform the Foundation of any replacement of players no later than Friday 24 February.
• The registration fee includes the amount of $77.50 for Public Liability and Personal Injury Cover, supplied through the Australia Touch Association Incorporated Sports Injury Scheme.
• A team consists of a minimum of 8 players and a maximum of 10 players.  Players must be over the age of 18.
• The Foundation accepts no responsibility for any kind of loss or liability suffered or incurred by any participant in the Sweetheart Challenge – Touch Footy Comp.     

Fundraising Competitions

• Prizes for the Fundraising Competitions will be awarded to the participants and teams as indicated hereunder.   The Prizes may not be transferred or redeemed for cash.
• All Fundraising Competitions close at midday on Friday 2 March 2012 and determination of the Winners will take place immediately thereafter at the Foundation offices.
• Winners will be announced at the end of play on Sunday 4 March 2012 and/or notified by phone and details published on the Foundation’s website heartresearch.com.au
• The Foundation shall not be liable for any loss or damage whatsoever which is suffered or sustained in connection with the Prize, except for any liability which cannot be excluded by law.

A. Prize for ‘Player that raises the most’

• The winner will be the person who has raised the most funds through their online fundraising page.
• Should two or more participants raise the same amount, a random draw will take place with 1st drawn winning the prize.
• The prize will awarded at the end of play on Sunday 4 March or be available for collection at the Foundation offices from Monday 5 March 2012.  

B. Prize for ‘Team that raises the most’ 

• The winner will be the team that has raised the most funds through their online fundraising page.
• The winning team will be announced at the end of play and/or the team captain will be notified by phone and details published on the Foundation website heartresarch.com.au
• Should two or more teams raise the same amount, a random draw will take place with 1st drawn winning the prize.
• The prize and the ‘Sweetheart Challenge Cup’ will be awarded on the day/or be available for collection at the Foundations offices from Monday 5 March 2012. 
• The team that is awarded the ‘Sweetheart Challenge Cup’ may be asked to be involved in future promotion of the event. 

C. Prize for ‘Fundraise and Play for Free’ 

• Once a team reaches the fundraising goal of $1500, the team will be eligible to receive a refund of their initial registration fee of $55 per player.  Public Liability and Personal Injury Cover fee of $77.50 per team is not refundable.
• Instructions on how to receive the refund will be sent via email to eligible Team Captains, as named in the registration details. 

D. Prize for ‘Northern Suburbs Rugby Football Player on your team’ 

• Once a team reaches the fundraising goal of $1500 the team will be eligible to have a Northern Suburbs Rugby Football Player (NSRFC player) play on their team for one game.
• The choice of which game to play and the duration of play is at the discretion of each NSRFC player assigned to a team.

Offline Fundraising events and activities 

• “Offline Fundraising” means all fundraising events and activities conducted in support of the North Shore Heart Research Foundation Sweetheart Challenge Touch Footy Comp excepting donations made via the individual’s/team’s online fundraising page.
• The Foundation shall not co-ordinate or assist with the conduct of any offline  fundraising events and/or activities on behalf of participating individuals or teams, eg ticket sales, soliciting prizes or organising celebrities. Offline fundraising, including the financial aspects, raffles, record keeping and management of events and activities shall be conducted in the team’s (the fundraiser’s) name and is the sole responsibility of the fundraiser.
• The fundraiser must take all reasonable steps to ensure that expenses incurred in fundraising do not exceed a fair and reasonable proportion of the gross proceeds obtained from the event. The Charitable Fundraising Act states this as expenses not exceeding 50% of the gross proceeds.
• The proceeds of fundraising and details of actual income and expenditure associated with the event shall be sent to the Foundation by the fundraiser no later than 14 days after the completion of the event.
• The Foundation may issue individual receipts for supporters of fundraisers’ events, if they have donated $2 or more to the Foundation. To obtain receipts, fundraisers must send the Foundation a list of supporters requiring receipts, including name, address, phone number and donation amount. 
• Some activities require permits, e.g. raffles with a total prize pool over a certain amount. Permits are also required by councils and shopping centres for outdoor events. All queries should be referred to the Foundation (02) 9436 0056
• All aspects of financial management, public liability and public safety for fundraising events organised by fundraisers are the responsibility of the fundraiser. As the Foundation is not the organiser of these events, it is unable to cover any liability on behalf of the fundraiser. The fundraiser agrees to release the North Shore Heart Research Foundation to the fullest extent permissible under law for all claims, except where such liability arises because of the negligence of the Foundation or its agents. Please ensure that any space or venue used for fundraising activities has the required public liability insurance.
• [NOTE: Payment of the $77.50 insurance fee with  Player Registration provides public liability and personal injury cover for the team’s participation in the tournament on 4 March 2012.  It does not cover public liability or other insurances for any other events run in connection with the Sweetheart Challenge Touch Footy Comp.

Using the North Shore Heart Research Foundation’s name and logo

• The Foundation may sanction the use of a line of copy stating the relationship between the fundraiser and the Foundation for all promotional material. Recommended wording would be, ‘This event proudly supports the North Shore Heart Research Foundation’ or ‘Your donation will fund research to help beat heart disease’.
• The words “North Shore Heart Research Foundation” or “Sweetheart Challenge” must not be used in any promotional material in relation to a fundraising event without prior approval by the Foundation.

Media and public relations

• All media materials and press releases must be approved by the Foundation prior to circulation. Please allow 10 days for approval. We are happy to discuss your ideas, and to give you a sample press release.
